    Do not know how it is in other states but in Texas when a car is totalled the insurance company pays you the value of the car (their value) and the insurance company takes the car. Naturally, the insurance company will sell the car for salvage and thus are out only the difference. If you want to keep the car then the insurace company will pay only the delta between the determiend value of the vehicle and the salvage value. Of course, this is not an absolute... I know a guy who his 95 car in excellent condition & extremely low miles was rear ended. Only damaged the bumper but the repair would cost more then the "book" value of the car. The insurance company gave him a check for the value of the car and told him to have a nice day. He kicked in a few bucks and had the car repaired.

      In 1992 my 80 year old Mother got T-Boned in her 1970 Malibu with 35000 miles on it. She walked away unharmed but the cars passenger door and part of the rear quarter were banged up pretty good. She drove the car home. I had to take it to a body shop for an estimate. The insurance company totaled it right away and gave her a check for $1500.00 and the body shop gave her a check for $1500.00 for the wreck. So she got probably about what she paid for the car new. My son was sick, she had promised him that car. In 2000 I had a 93 Dodge pick up I had since new as my go to work truck. The truck had been paid for but I still had it on my policy with my other cars with full coverage. After a hail storm it got beat up pretty bad, I didn't think anything of it till I saw all the items in the paper about insurance companies having to pay all these claims on hail damage. I called Progessive and they sent a guy to my house. He looked my truck over and asked me if I had the title or the bank, I told him I had it. He went to his car and came back with a check for $2000.00 after subtracting my $500.00 deductable. He told me if I couldn't get it fixed with that much money to call him back. I asked him if I had to get it fixed and he said no, not as long as you don't have a lien on it. I also called my homeowners insurance company and got a new roof. You couldn't see any damage from down below, but I got up on the roof with the adjuster and he flipped back one of my shingles and you could see were a hail stone had hit it and spalled the asphalt on the back side, he said in time water would seep through those cracks. At that time I owned a Duplex on the other side of town and got a new roof on it too. Leroy

        Well ,after all the run around from the Ford Dealer and insurance co. we finally came to an agreement today. They totaled the car and gave my daughter a check for $23,800. I felt that that was a very fair price since the 02 Bird had almost 90,000 miles on it.
        I want to thank all the members who tried to help me with their input and suggestions. Special thanks to Rick at World Class Wheels. This is truely a site of very special people.
        Now the search is on for another Bird. I checked Auto Trader and there are 595 Birds for sale nationally. If any one knows of a member who has a 02 or 03 with low miles for sale, please PM me.

          Ron, Happy this has worked out for your daughter and she is shopping for a new Bird. Does she have a color preference or is it a given she wants another TR?

            Red is her favorite color, but she is open to others also. If she goes for an 03 or 04 then she will have many options. I think she may be a little gun shy about red after what happened to her 02 Red Bird.

                Sounds like a great settlement for an '02 with those miles. She should be able to replace it very easily with that amount and should be able to get something with way less miles and newer.

                There are lots of nice colors out there but I'm sure she knows that RED is the best and certainly worth replacing the first one with.

                  This is very sad, almost sickening, and very frustrating that such a beautiful bird was totaled. It appears by the picture, it was very well taken care of and more than just a machine.

                    Hi Ron, Did they offer to sell you the damaged tbird at a certain price? I am sure alot of people would be interested in that since the damage is not to bad. Thanks, Rick

                      I would look on Ebay for an 05 that is still under the 3Yr.-36K warranty and then extend it. It's a buyers market out there. Leroy
